It&#8217;s the first monopoly trial in the internet age\u00a0<\/strong><\/li>\n<\/ul>\n<p>Google will battle back government claims it stifled competition by creating an online monopoly in court today &#8211; in what is set to be one of the biggest antitrust trials of the century.<\/p>\n<p>Already underway, the proceedings began with both sides&#8217; opening statements at 9:30am &#8211; with the Justice Department being the other principle.<\/p>\n<p>A veteran DoJ lawyer who served on the legal team of the government&#8217;s last big monopoly case began the arguments\u00a0claiming\u00a0the firm abused\u00a0its dominance in search\u00a0through deals with wireless carriers and smartphone makers.<\/p>\n<p>Claiming the dealings made it so their search engine was the first thing users see when they turn on their phones and browsers, lead litigator Kenneth Dintzer said he and his team have documents &#8216;that capture exactly&#8217; what Google did.<\/p>\n<p>A 30-year veteran of the justice department, he showed the court a 2007 presentation where a Google engineer allegedly said obtaining default search positions on devices from firms like Apple, LG and Samsung could be a &#8216;powerful strategic weapon\u201d for the company&#8217;s business &#8211; and an &#8216;Achilles heel&#8217; for rivals.\u00a0<\/p>\n<p>The Justice Department&#8217;s case hinges on claims Google knowingly orchestrated those business dealings, with goal of rigging\u00a0the market and<span>\u00a0stomping out its competitors.\u00a0<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter\" src=\"https:\/\/i.dailymail.co.uk\/1s\/2023\/09\/12\/13\/72123731-12508927-A_Google_sign_is_shown_at_the_company_s_office_in_San_Francisco_-a-1_1694522208490.jpg\" height=\"422\" width=\"634\"><\/p>\n<p>Google will battle back government claims it stifled internet competition by creating an online monopoly in court today &#8211; in will be one of the biggest antitrust trials in recent memory\u00a0<\/p>\n<p>\u00a0&#8216;Google illegally maintained a monopoly for more than a decade,&#8217; Dintzer on Monday asserted, before giving the floor to attorneys representing\u00a0states and territories that also sued Google in 2020 on the basis the firm abused its monopoly power over search.<\/p>\n<p>\u00a0Their lawsuit, led by Colorado, is being considered alongside the Justice Department\u2019s, and makes\u00a0additional allegations against Google.<\/p>\n<p>Their suit claims that the way Google structures its search results page harms competition by prioritizing the company\u2019s own apps and services over content from third party sites, as well as other web pages, links, and reviews.<\/p>\n<p><span>Google, meanwhile counters it faces a wide range of competition from sites like Microsoft&#8217;s Bing, despite commanding roughly 90 percent of the internet search market.\u00a0<\/span><\/p>\n<p><span>A hint of what&#8217;s to come over the next ten weeks, it&#8217;s the government&#8217;s first major monopoly case in a quarter century, and the first in the age of the modern internet.<\/span><\/p>\n<p>It&#8217;s the government&#8217;s first major monopoly case in a quarter century, and the first in the age of the modern internet.\u00a0<\/p>\n<p>&#8216;This lawsuit strikes at the heart of Google&#8217;s grip over the internet for millions of American consumers, advertisers, small businesses and entrepreneurs beholden to an unlawful monopolist,&#8217; ex-Attorney General William Barr said when the case was first filed in October 2020.<\/p>\n<p>His deputy, Jeffrey A. Rosen, cited previous antitrust cases like its one in 1998 against Microsoft, which centered around claims the firm illegally grouped its products in a way that stifled competition and compelled people to use them.<\/p>\n<p>He also brought up what&#8217;s been billed as the last century&#8217;s Ali-Frazier of telecom fights, when the U.S. Department of Justice went toe-to-toe with AT&amp;T\u00a0in 1974 and broke up the old American Telephone &amp; Telegraph into the new, seven regional Bell operating companies (RBOC)s\u00a0 &#8211; and the much smaller, new AT&amp;T.\u00a0<\/p>\n<p>&#8216;As with its historic antitrust actions against AT&amp;T in 1974 and Microsoft in 1998, the Department is again enforcing the Sherman Act to restore the role of competition and open the door to the next wave of innovation,&#8217; then-Deputy AG said at the time.\u00a0<\/p>\n<p>&#8216;This time in vital digital markets.&#8217;<\/p>\n<p>Aside from the historical significance of those trials, they provide a somewhat dubious legal precedent for the Silicon Valley search firm.<\/p>\n<p>In the case involving Microsoft &#8211; where officials argued the then highflying company illegally maintained its monopoly in the PC market through the legal and technical restrictions on manufacturers and users to uninstall Internet Explorer &#8211;\u00a0the judge ruled in favor of the Justice Department.<\/p>\n<p>A landmark ruling, it saw Judge Colleen Kollar-Kotelly declared that Microsoft &#8211; by not allowing its users to use competing apps such as Java or Netscape &#8211; violated antitrust laws and held &#8216;an oppressive thumb on the scale of competitive fortune.&#8217;<\/p>\n<p>Now, more than two decades later, the similarities to the case and the new one against Google stand out as strikingly similar &#8211; and attorneys enlisted by the government are angling for a similar outcome.\u00a0<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter\" src=\"https:\/\/i.dailymail.co.uk\/1s\/2023\/09\/12\/14\/61232379-12508927-Google_s_headquarters_are_pictured_in_Mountain_View_California_T-a-2_1694525050666.jpg\" height=\"424\" width=\"634\"><\/p>\n<p>Google&#8217;s headquarters are pictured in Mountain View, California.
